Terms of business
These terms cover the work Newington Press does for you: family editions and editions for sale, audiobooks, archive search, and keeping a book in print. Newington Press is a trading name of Focal Point International LLC, 701 Tillery St, Unit 12-2475, Austin, TX 78702, United States. Contact: hello@dawnchild.com. Your quote sets out the details of your job; where it differs from these terms, the quote applies.
1. Quote and acceptance
We quote in writing after seeing photographs or a sample of the book. The quote gives the scope, the price, the payment stages and the timetable. A contract starts when you accept the quote in writing and we confirm.
2. Prices and payment
Prices are in pounds and are fixed in your quote, which also says what postage costs for your copies and for returning any original you lend us. Unless the quote says otherwise, half is due when you accept it and the rest when you approve the proof (for audio, when you approve the finished recording; for archive search, at the start of the pilot and then monthly). Further printed copies and any additions you ask for are priced before we do them.
3. Your right to cancel (consumers)
If you are buying as a consumer, you can cancel within 14 days of the day the contract starts, without giving a reason. To cancel, tell us clearly, for example by email to hello@dawnchild.com; you can use the form below but you do not have to. We refund what you have paid within 14 days of hearing from you.
We start work within the 14 days only if you ask us to in writing and confirm that you understand two things: that if you then cancel you pay for the work done up to that moment, and that you lose the right to cancel once the work is finished; you then pay a fair share of the price for the work done up to the moment you tell us, and we refund the rest. If you ask us to start and the work is then finished within the 14 days, the right to cancel ends when it is finished. Copies printed to your specification, such as your family edition, cannot be returned for a change of mind, though faulty copies are always replaced.
Cancellation form (complete and return only if you wish to cancel)
To Focal Point International LLC, trading as Newington Press, 701 Tillery St, Unit 12-2475, Austin, TX 78702, United States, hello@dawnchild.com: I hereby give notice that I cancel my contract for the following service: [service] · Accepted on: [date] · Name: [name] · Address: [address] · Signature (only if this form is sent on paper) · Date: [date]
After the 14 days you can still end the work at any time by telling us. You pay for the work done up to then and for any costs we have already committed to and cannot recover, such as copies already printed, and we refund the rest.
4. Your material and the rights
You tell us honestly what you know about who owns the rights to the text, the pictures and any recordings, and you confirm that you have permission to republish where copyright still applies. We check before quoting and may decline or stop work if the rights turn out not to be clear; if we stop for that reason, you pay only for work already done, and we refund anything you have paid for work not done. Any original book you lend us is handled with care, never unbound, and returned tracked.
5. The work
We do the work with reasonable care and skill and to the timetable in the quote. We keep the author’s pictures and words; we never redraw pictures or replace them with generated ones. Narration is made with a synthetic voice and is labelled as such wherever it is published. A voice made from a family member’s reading is made only from a living person’s own recorded consent and with permission from whoever owns the recordings.
6. Proofs and corrections
You approve a proof before anything is printed or released. One round of corrections is included; further rounds are quoted. Errors we introduce are always corrected at our cost.
7. What you own
Copyright stays with whoever owns it now. The print files we make for your edition are yours. If we publish the book for you, our separate publishing agreement sets out our share of what we receive for each copy (after printing and post), how and when you are paid, and how either of us can end it; if you take the book elsewhere you keep the files and the right to republish, and the new publisher uses new ISBNs.
8. Archive search
Archive search is a service for organisations. Before a pilot we agree in writing what material is indexed, who can use the search, and a data-processing agreement covering how we handle any personal information in it. Archive text is never sent to an outside AI company. You can stop the service at the end of any month and take an export of the index.
9. If something goes wrong
Tell us first at hello@dawnchild.com; we acknowledge within two working days and try to put it right quickly. If we cannot finish the work, we refund what you have paid for work not done. Nothing in these terms limits your rights as a consumer, including the work being done with reasonable care and skill. We are responsible for losses that are a foreseeable result of our breaking these terms or failing to use reasonable care; we are not responsible for losses that were not foreseeable. For business customers our total liability for a job is limited to the price of that job, except where the law does not allow a limit.
10. Law
These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the United Kingdom or in the European Union, you keep the protection of the law where you live and can bring a claim in your local courts.
